Microsoft's Windows Phone 7 software has a unique, modern design that many say is superior to Android's more rugged, computery look. But a former Microsoft staff says looks alone are not enough to make Windows Phone succeed. Microsoft introduced Windows Phone 7 in November 2010, and has since formed a major partnership with Nokia in hopes of gaining a foothold in a mobile market that is dominated by Apple and Google.

Despite the firm's best efforts, sales of Windows Phone 7 handsets are still tiny. Charlie Kindel, an entrepreneur who recently left Microsoft's Windows Phone team to start his own company, wrote a blog post Monday on why the software still hasn't taken off. He breaks down what each party in the cellphone business wants - most notably, the carrier and hardware maker.

The carrier wants to control the customer experience, and the manufacturer wants to own that and the hardware design as well. This is precisely why Windows Phone 7 faces hurdles, Mr Kindel says. To explain, Mr Kindel analyses Apple's approach with the iPhone and Google's approach with Android.

With the iPhone, Apple controls the design of the software and additional transactions through the App Store, and it controls its own destiny with hardware because it makes the iPhone itself. With Android, Google licenses the software to any manufacturer that wishes to use it, and allows the carriers to distribute Android software updates whenever they want. Many hardware makers and carriers are willing to play ball with Android, because it "bows down" to them.

With Windows Phone 7, Microsoft tells the carriers when they must issue software updates, and tells manufacturers how they must design the phones in order to run the operating system. This ensures a consistent experience among different devices. And that is why Windows Phone faces so much difficulty gaining traction in the market, Kindel says. It creates friction among Microsoft, the carriers and the manufacturers.

M-Edge suit accuses Amazon of corporate bullying, patent infringement over Kindle cases

Case maker M-Edge filed suit with a Maryland court last week accusing Amazon of "unlawful corporate bullying" and patent infringement relating to the company's line of Kindle cases. According to M-Edge, the company signed a three-year agreement with Amazon in November 2009 for a 15-percent sales commission, only to have the retail giant demand a new contract with a 32-percent cut a mere two month later. A lawyer for M-Edge told The Wall Street Journal that Amazon punished the case maker over its refusal to play ball, after threats of burying the company's products on its site. According to the filing, M-Edge finally caved and signed a new contract in July of last year, given the fact that Amazon apparently drives nearly 90-percent of the small company's revenue. The suit also accuses Amazon of "knocking off" its reading light-packing covers with lighted jacket designs for the Kindle 3. Amazon, for its part, has refused to comment on the matter.

Much like the other TiPb staff, my most used apps are the native applications that come pre-installed on the iPhone and iPad, but unfortunately they don?t meet ?all my needs. I have spent a lot of time (more than I would like to admit) in the App Store looking for applications that fit my needs, and I have found a bunch that I use on a daily basis.

Camera +

I love to take pictures with my iPhone 4, for a cell phone camera it can take some rather stunning pictures, but sometimes you need just a small edit or two to make it what you really like. Camera + allows me to not only take great pictures, but it loads quicker than the stock camera, and allows me to further crop and edit my photos than the stock one allows. The additional filters and edits allow me to take a standard picture, spice it up a bit and then share it right from the app if I wish.

Sonos

One of my favorite gadgets that I got this year was a Sonos system, and the ability to control it from my iPhone makes it even better. The Sonos controller is only helpful if you have a Sonos system to use it with, but it allows me to easily manage multiple zones of audio in my house, set alarms, download firmware updates for the system and much more. If you have a Sonos system this application is a must have on your iOS device.

Tweetbot

Twitter is a great social media tool, and Tweetbot does a great job of allowing you to make the most out of Twitter in an enjoyable fashion. With added features like double and triple tap, swiping left and right and more the application is not only packed with features, but absolutely beautifully designed. If you enjoy a well designed, feature loaded application that won?t break the bank, this is a great choice.

Google +

Google+ isn?t such a hit all around with everyone, but being an Android user also (insert your boo here) I love Google+ and the iPhone application offers a pretty good experience for it. Google+ is a great way to communicate with a wide variety of people and the threaded replies to posts keep it nice and organized. The iPhone application appears to receive as much support from Google as the Android version which makes me happy, and the control of the notifications is great with tons of options.

AirToDo

Recently in an effort to remain organized, and become more productive I have begun using Google Tasks since I live in my Gmail inbox, and can easily add tasks to be reminded about at a later time. Finding an application that offered solid sync, push notifications and some added features was a bit of a struggle but AirToDo has nailed every feature I needed, and more. Being able to set reminders by time and date is awesome, and you can add notes, locations, and more which help keep you nice and organized.

Senate GOP will vote for new leader Tuesday

ST. PAUL, Minn. -- Less than two weeks after Senate Majority Leader Amy Koch resigned, her colleagues are getting ready to elect her replacement. The Senate GOP Caucus will vote Tuesday morning for their next leader.

Larry Jacobs, a professor of political studies at the Humphrey School of Public Affairs, said whoever the leader is will not only have to help the party recover from Koch's scandal but also dig the GOP out of more than $1 million of debt.

Jacobs believes numerous names will be thrown into the ring but he expects Sen. David Hann to be at the top.

"He's someone who has a lot of support but he does come from the more conservative wing of the Republican Party" Jacobs said.

KARE 11 reached Hann by phone Monday but he declined to say if he was seeking the position.

Another name topping the list is Sen. Geoff Michel. Michel is the current interim majority leader. Jacobs said Michel is a more moderate Republican who might help the Republicans win in the tough 2012 election.

Before facing voters in 2012, the Senate GOP Caucus will need to pick a leader who can help unify the party and recover from Koch's fall from grace. If they don't, Jacobs warns Republicans may lose the majority they gained just last year.

Clerics clash in Church of the Nativity (Reuters)

BETHLEHEM, West Bank (Reuters) ? A Christmas cleaning of the Church of the Nativity turned into scuffles on Wednesday between rival Christian clerics zealously guarding denominational turf at the holy site.

Brooms and fists flew inside the church marking the birthplace of Jesus as some 100 priests and monks of the Greek Orthodox and Armenian Apostolic churches brawled.

Palestinian police, bending their heads to squeeze through the church's low "door of humility," rushed in with batons flailing to restore order.

"It was a trivial problem that ... occurs every year," said police Lieutenant-Colonel Khaled al-Tamimi. "Everything is all right and things have returned to normal," he said. "No one was arrested because all those involved were men of God."

Administration of the 6th century Bethlehem church, the oldest in the Holy Land, is shared by Roman Catholic, Greek Orthodox and Armenian clerics.

Any perceived encroachment of jurisdictional boundaries within the church can set off a row, especially during the annual cleaning for Orthodox Christmas celebrations, which will be held next week.

Lower Indian house passes anti-graft bill (AP)

NEW DELHI ? The powerful lower house of India's Parliament passed a contentious anti-corruption bill Tuesday after hours of fierce debate even as a protest leader began a three-day hunger strike demanding Parliament adopt his tougher proposals.

The "Lokpal" or watchdog bill was passed after several amendments suggested by opposition lawmakers. The bill now must be passed by the upper house and signed by the president before it comes into effect.

"Let us pass this bill because the people are waiting for us," Finance Minister Pranab Mukherjee said at the end of an impassioned speech.

The bill was passed by voice vote by a majority of the members present. The lawmakers, however, rejected a portion of the bill that aimed to amend the constitution and make the watchdog a constitutional body because the government wasn't able to garner the support of two-thirds of the members voting.

The legislative showdown is the culmination of months of angry political debate and public protests that brought tens of thousands of middle-class Indians fed up with rampant corruption into the streets and put a government battered by scandals deeper on the defensive.

Hoping to defuse activist Anna Hazare's anti-corruption crusade, the government initiated debate Tuesday on a bill to create an anti-graft watchdog. But that failed to satisfy Hazare, who began his fast in India's business capital, Mumbai, demanding the proposed ombudsman be made more powerful.

After close to six hours of debate, Prime Minister Manmohan Singh rose to defend the government's bill, saying that the powers of the proposed watchdog needed to have checks in place.

"Let us not create something that will destroy all that we cherish all in the name of combating corruption," he said.

"I urge all my colleagues in Parliament to rise to the occasion and look beyond politics to pass this law," Singh said.

Hazare has called the government's anti-graft legislation an attempt to fool the country.

Hazare's main complaint with the anti-graft bill before Parliament is that the proposed corruption ombudsman would not have authority over the country's top investigative agency, the Central Bureau of Investigation. He says the ombudsman position would be too weak without that authority.

In New Delhi, India's Parliament began its debate with the government saying that the legislation maintained the "fine balance" between the powers of the legislature, the judiciary and the executive branch.

Sushma Swaraj, the leader of the main opposition, right-wing Bharatiya Janata Party, however, said that as the country waited for a "strong and effective" anti-corruption watchdog, the government was offering a bill that was "so full of holes and flaws that it has disappointed all of us."

Swaraj's party has thrown its weight behind Hazare's protest.

The legislation covers senior politicians and officials. The prime minister's office is under its purview, but with restrictions. But it gives the ombudsman no powers to conduct independent investigations into complaints of graft.

Hazare has fasted three times already. He started with a five-day fast in April, after which the government invited members of his team to help draft the legislation.

In the end the bill that was passed by the lower house kept the CBI free from the control of the watchdog. The changes that the government accepted included Swaraj's demand that the provisions of the anti-corruption law not be binding on state governments, who should be free to enact their own anti-corruption legislation.

Eight hours were set aside for the debate in Parliament's lower house on Tuesday but the debate lasted close to 11 hours. The upper house is set to debate and likely pass the legislation on Wednesday.

At the Mumbai fairground where he is fasting, Hazare told supporters earlier in the day that the proposed bill was a "fraud perpetuated upon the people by the government" and that they would teach lawmakers a lesson.

He said his supporters would travel across the country to campaign against all those political parties who did not support his version of the bill.

He has also asked his supporters to court arrest after he ends his fast on Dec. 29.

Hazare, who claims inspiration from Mohandas K. Gandhi, has called his protest against corruption India's second freedom struggle and has fasted three times already to garner support for his demands.

Thousands of people, many waving Indian flags and wearing the trademark white cap made popular by first independence leader Gandhi and now Hazare, gathered in support. As of Tuesday afternoon, the crowd was thinner than the tens of thousands Hazare drew to an August protest in the Indian capital.

Hazare is not without critics who say his populist campaign attempts to vilify all politicians and hold elected officials hostage.

Dozens of those critics also came out on the streets Tuesday, waving black flags and shouting slogans as Hazare's motorcade passed through the city.

Doctors were monitoring Hazare's health and said that he was running a fever and his blood pressure was high. News reports said that ambulances were waiting on standby near the fairground.

Arvind Kejriwal, a key Hazare aide, said that his supporters had been asking him to break his fast and take medication but until late Tuesday he had refused to do so.

Study: San Francisco Bay oil spill damaged herring (AP)

SAN FRANCISCO ? The cargo ship accident that dumped tens of thousands of gallons of thick, tarry ship fuel into San Francisco Bay caused lasting damage to the region's once-plentiful schools of Pacific herring, the bay's only commercially fished species, according to a study released Monday.

Herring embryos collected from shorelines left coated in oil starting about 3 months after the November 2007 Cosco Busan spill suffered from unusually high death rates and a range of ailments and deformities associated with exposure to the chemicals in crude oil, the study found.

"The majority of embryos in samples from oiled sites were dead on examination in the laboratory," wrote the study's authors, who were led by John Incardona, a toxicologist with the fisheries division of the National Oceanic and Atmospheric Administration.

By 2010, death rates had returned to normal, but the embryos continued to show heart defects that are a common symptom in herring of oil exposure.

The bay's Pacific herring are the largest coastal population in the continental U.S. and a key element of the bay's complex food web, according to the study, which was published online by the Proceedings of the National Academy of Sciences.

The spill that resulted from the massive cargo ship striking one of the pillars of the San Francisco-Oakland Bay Bridge in heavy fog killed more than 6,800 birds and closed beaches to swimmers for weeks.

In 2009, California regulators cancelled the bay's herring fishing season, which typically begins in January. The state said the herring populations in the bay had reached an all-time low, with the causes ranging from drought to pollution from the oil spill.

The north-central San Francisco Bay shorelines left coated in oil and littered with sticky tarballs are one of the historic spawning grounds for the bay's herring. Only about half the oil along those shores was recovered, and an unknown amount remained submerged near the water's edge, the study said.

The study's authors knew from herring harmed in Alaska's Exxon Valdez oil spill in 1989 that those same fish in San Francisco Bay would likely be threatened. Unlike the Valdez spill, which sent hundreds of thousands of barrels of crude oil spilling into Prince William Sound, the Cosco Busan leaked bunker fuel, a mix of diesel and fuel oil left over from the crude oil refining process.

Embryos exposed to chemicals in crude oil suffer from a range of maladies, from heart problems and deformities to swelling and cancer. Similar symptoms were seen in embryos collected for the San Francisco Bay study.

The problems did not seem to be caused naturally or by other pollution in the bay, the study's authors wrote. They said the only common feature of three sites where the embryos were collected was that they were exposed to oil.

Jonathan Maul, a toxicologist with The Institute of Environmental and Human Health at Texas Tech University who was not involved in the study, said the researchers faced difficulty in showing that the toxins came from the Cosco Busan's bunker fuel and not other sources in the environment. He said the study should encourage scientists to look further into the toxic effects of oil contamination.

"Overall I believe it is a valuable study and should garner attention toward impacts to early life stages of fisheries," Maul said.

Because the chemical levels found in the embryos didn't seem high enough to cause the high death rate, the study concluded that exposure to sunlight played a part in making the spill more deadly.

"One or more of these unidentified chemicals likely interacted with natural sunlight in the intertidal zone to kill herring embryos," the study said.

Falcons lead Saints 10-7 after first quarter (AP)

NEW ORLEANS ? Matt Ryan hit nine of his first 12 passes for 120 yards, including a 21-yard scoring strike to Julio Jones that gave the Atlanta Falcons a 10-7 lead over the New Orleans Saints after one quarter on Monday night.

Both teams scored on all of their possessions in the opening quarter, with the Saints briefly pulling in front 7-3 on Pierre Thomas' 4-yard touchdown run, after which he pulled a bow from his uniform pants, put it on the football and offered it as a gift to a woman with a parasol in the front row behind the end zone.

The referees weren't cutting Thomas any slack on his Christmas-themed celebration, flagging him for a 15-yard unsportsmanlike conduct penalty.

The score capped an eight-play, 84-yard scoring drive on which Drew Brees completed two passes for 49 yards as he closed in on Dan Marino's 1984 single-season yards passing record of 5,084. Brees entered the game needing 305 yards to pass Marino's mark.

The Saints entered the game needing only one victory to clinch the NFC South title, while Atlanta could remain in the hunt to defend its 2010 division crown with a win.

After Atlanta received the opening kickoff, Ryan completed five of his first six throws for 52 yards, including a 20-yard completion to Roddy White at the New Orleans 23. The Saints' defense stiffened there, however, forcing Atlanta to settle for Matt Bryant's 34-yard field goal and an early 3-0 lead.

The Saints responded immediately, with Brees hitting Lance Moore for a 38-yard gain on New Orleans' first play from scrimmage. The Saints then went to the running game, with Chris Ivory rushing one time for 11 yards and Thomas three times for 24 yards, including his short TD run.

Thomas' unsportsmanlike conduct penalty, enforced on the ensuing kickoff, was not terribly costly, as Eric Weems returned it to the Atlanta 28. More costly was the Saints inability to slow down Ryan, who quickly found Jones for a 25-yard gain and White for 16 yards to set up the scoring pass to Jones.

Rudolph Would Have Run Away From Santa

According to holiday lore, poor Rudolph was a victim of social exclusion because he was different from the rest of the reindeer. In a move that was lucky for nice (but not naughty) children everywhere, he was then approached by Santa, who asked him to guide the sleigh. Thereafter, according to traditional sources, all the reindeer loved him.

Like most bits of religious lore, however, the Rudolph story is rife with scientific errors. For one thing, it takes more than special attention by an authority figure for bullies to stop picking on those whom they perceive to be different ? in fact, this often only serves to further isolate those who are victimized by bullying. But a bigger problem with the story is that reindeer ? like most non-domesticated animals ? are exceedingly unlikely to stick around long enough when a human approaches to have time to consider an offer like guiding a sleigh.

While cross-country skiing has been a human pastime in Norway and elsewhere for centuries, the activity has seen a recent increase in the last fifty years, owing to the continued construction of mountain cabins and ski lodges, and improved access to alpine areas due to the development of road and trail systems. With the increase in skiing also comes an increase in other snow activities, such as snowmobiling. In 2002, for example, there were 49,260 snowmobiles in operation in Norway.

This could be problematic for the 30,000 to 40,000 reindeer inhabiting the twenty-six defined ?management areas? in Norway. During the harsh winter, reindeer typically reduce their activity and rely on a combination of stored fat and limited, nutrient-poor foods such as lichens in order to survive. The increasing human presence in reindeer habitats, therefore, could force the reindeer to use more energy than is optimal as they attempt to avoid human interaction. This could also reduce the time that reindeer can spend grazing. Taken together, human encroachment could have the compound effect of reducing the body weight of reindeer, and for females, their conception rate and age of first reproduction.

In an effort to understand how increasing tourism in remote parts of Norway could affect wild reindeer populations, researchers from the University of Norway compared the behavioral responses of reindeer (Rangifer tarandus tarandus) to humans on skis and to snowmobiles, in Setesdal-Ryfylke, in southern Norway (area 1 on the map, above right, click to enlarge).

Since the 1990s, the winter population in the study area has been stable at about 3000 reindeer, with approximately 800 calves born each year. On average, this comes out to one reindeer for every two square kilometers. Part of the reason for choosing this study area was the lack of large predators ? this helps to ensure that reindeer responses to approaching skiers or snowmobiles aren?t affected by other nearby threats.

In order to collect their data, an observer approached a reindeer herd at a constant speed (4 km/hr for skiers, and 20 km/her for snowmobiles) until they had reached the original location of the herd.

For each incident, they recorded nine variables: the provocation method (ski or snowmobile), weather (sunny, cloudy, raining, snowing, foggy), wind speed, topography (level or hilly), activity of the reindeer prior to provocation (lying, foraging, moving, or a combination), herd size, herd composition, wind direction (relative to the reindeer), and the original position of the observer (relative to the reindeer).

In addition, they measured seven response variables:

  • (1) Start distance: distance between observer and the estimated center point of the herd at the beginning of the provocation.
  • (2) Sight distance: distance between the observer and the herd center point when more than 1 reindeer looked up in the observer direction.
  • (3) Fright distance: distance between the observer and the herd center point when the herd exhibited a fright response by grouping together.
  • (4) Flight distance: distance between the observer and the herd at the moment of flight.
  • (5) Escape distance: air distance from where reindeer took flight to where they resumed more relaxed behavior (i.e., grazing or lying).
  • (6) Total flight: air distance covered if the herd moved farther away from the observer after resuming more relaxed behavior the first time, and we determined that the movement was caused by the provocation.
  • (7) Total distance moved: total flight distance measured by total ground distance covered. The air and ground distance are equal if the reindeer escape in the same direction upon provocation. Any directional change during escape makes the ground distance longer.

In order to collect enough data, they repeated this each winter for three years.

The results were straightforward. Reindeer movement distances varied between 134 and 2,526 meters, with an average distance of 600 meters for snowmobiles and 970 meters for skiers. Compared to disturbances by skiers, reindeer became aware of snowmobiles (?sight distance?) at longer distances. However, their physical displacement was shorter for snowmobiles than for skiers (?total flight? and ?total distance?). The researchers conclude that ?reindeer were more easily disturbed by snowmobiles, but reacted stronger when provoked by skiers.?

Additional analyses indicated that ?fright distance? was larger when approached from downhill than from uphill, and ?escape distance? was farther when they had been lying rather than grazing.

It?s possible that the reindeer were able to notice the snowmobiles sooner due to the noise from their motors or the flashing from the headlights. Even still, skiers seem to disturb them more than snowmobiles, which is perhaps surprising. The researchers hypothesize that this could be due to confusing skiers for hunters. They write, ?hunting is not allowed from motorized vehicles in Norway, and chasing and harassing wildlife is strictly forbidden. However, reindeer are hunted by humans on foot and probably do not discriminate between a hunter and a tourist.?

It should also be noted that these responses probably represent something like a maximum response to approaching skiers or snowmobiles for these reindeer, because the researchers always directly approached the center of the herd. In natural interactions, however, it is more likely for reindeer to be approached obliquely rather than directly.

What does all this mean for regulating the tourism industry in places such as Norway with wild reindeer? Wild reindeer in Norweigian mountains don?t generally have more than three human encounters per day during the busiest tourist seasons. By combining this with the data from their experiment, the researchers calculated that reindeer would add approximately 3.4% to their daily energy expenditure for three skier encounters, and 2.3% more for three snowmobile encounters. They note that this extra energy expenditure should be easily compensated for, as long as these encounters are limited to the 2-4 week-long tourist season.

This is good news, though the work is far from over: it is still possible that loss of access to optimal habitats due to avoidance of areas frequented by humans, combined with subsequent overgrazing of undisturbed habitats could still have negative implications for the health of reindeer herds.

The other caveat is that these numbers hold only as long as snow levels remain constant. This is because deeper snow makes moving through it more effortful, meaning that more energy would be expended by reindeer in flight from approaching humans. It is not clear how climate change could enter into this process: it is possible that increased snowfall due to climate change could make it impossible for reindeer to compensate for even three encounters per day with humans.

When most animals are approached by an unfamiliar other, they engage a stress response known colloquially as ?fight or flight.? That is, the approach of a potential threat is alarming enough to the animal that it will retreat from the approaching human ? when possible ? or perhaps react with aggression. Energy Efficient Light Bulb Tips (PHOTOS)

Given the man light bulb choices available today and the new bulb efficiency standards that are set to go into effect in 2012, selecting the right bulb for your home can difficult. Below, check out the tips from the Natural Resources Defense Council for selecting the light bulb that both looks best and is energy efficient.

The efficiency standards that are set to take effect on January 1, 2012 mean that older, incandescent bulbs will be phased out. Consumers, however, will still have a choice between newer, more efficient incandescent bulbs, CFLs and LED bulbs, reports the NRDC.

Congressional Republicans included a rider in a spending bill last week that will delay enforcement of the light bulb efficiency law that was signed by President Bush in 2007. The Associated Press reports Rep. Fred Upton (R-Michigan) said, "Americans don't want government standards determining how they light their homes."

According to the NRDC, the change is hardly a coup. The Republican rider "pertains only to funding for federal enforcement of federal lighting standards for this fiscal year." The delay will not affect standards for manufacturers, or ultimately, consumers. Rocky Kistner, a HuffPost blogger with the NRDC, said "the money-saving law" is "good for American consumers -- and for American workers and their companies."

Light bulb manufacturers even oppose Congress' efficiency standards funding delay. A statement from the National Electrical Manufacturers Association, representing over 90 percent of the lighting industry, said the industry "remains committed and supportive of the lighting standards established [by the 2007 law]."

Japan prosecutors raid Olympus, former exec's home (AP)

TOKYO ? Japanese prosecutors raided the headquarters of Olympus Corp. and the home of its former president Wednesday as part of an investigation into the cover-up of massive losses at the camera and medical equipment maker.

A trail of dark-suited officials was shown on national television marching solemnly into the company's downtown Tokyo office building.

Olympus said it would fully cooperate with the investigation by prosecutors, police and financial authorities.

"We apologize deeply again for the great troubles and worries we have caused our shareholders, investors, customers and others," it said in a statement.

Tokyo prosecutors said the home of former President Tsuyoshi Kikukawa, who is suspected of helping to orchestrate the cover-up, was also raided, as were the offices of three companies used in the scheme.

The deception at Olympus dates back to the 1990s and involved an elaborate scheme to hide 117.7 billion yen ($1.5 billion) in investment losses. It only came to light in October when then President Michael Woodford blew the whistle on what he thought was strange and excessive spending.

Woodford, a Briton, had been a rare foreigner to head a major Japanese company.

The scandal has raised serious questions about corporate governance in Japan, and whether major companies are complying adequately with global standards.

Woodford was fired after he confronted the company's board of directors with his doubts. In recent weeks, he has been trying to stage a comeback to the top, by appealing to shareholders, employees and others that his return will work to clean up Olympus.

Woodford had questioned exorbitant fees for advice on the acquisition of British medical equipment maker Gyrus Group and other expensive acquisitions in 2008.

Woodford is demanding the resignation of the entire board, including President Shuichi Takayama, who replaced him and initially declared in a news conference that the spending was legitimate.

The battle over who will lead the camera and medical equipment maker and its 40,000 employees could come to a head at the next shareholders' meeting. A date has not been set.

The new Olympus management has expressed a willingness to consider alliances in an effort to get its finances back in order.

Olympus delayed reporting earnings because of the accounting irregularities, but met the stock exchange's deadline earlier this month, averting automatic removal from the market.

The company could still be delisted if the criminal investigation discloses major misbehavior.

In the past, erring executives have rarely got prison time for their roles in shady bookkeeping.

Covering up for investments that went sour after the 1980s "bubble" economy burst was so widespread in Japan that a special term describes the practice, "tobashi."

Olympus stock plunged amid the scandal but has recouped some of those losses in recent weeks. On Wednesday it slipped 1.4 percent to 1,050 yen.

The role of social structure in animal communication is hotly debated. Non-human primates seem to be born with a range of calls and sounds which is dependent upon their species. But overlying this there seems to be some flexibility - you can tell where a gibbon lives by its accent. New research published in Biomed Central's open access journal BMC Evolutionary Biology used Campbell's monkeys to look in detail at the nature versus nurture question and showed that non-human primate 'language', like humans, is learnt.

Researchers studied free-living Campbell's monkeys (Cercopithecus campbelli campbelli) from the Ta? National Park, Ivory Coast. They observed social interactions (time spent grooming) and recorded 'contact calls' made while the females were travelling, foraging or resting. Genetic similarity (family relationships) was determined by microsatellite analysis of DNA isolated from droppings. These monkeys have lived close to the Ta? Monkey Project Research Station for more than 10 years so their social structure and family groups are well known. Groups consisted of one male, four or six females, along with their offspring.

Dr Alban Lemasson who led the multi centre team explained, "Each female has its own distinctive vocalisation but they appear to pick up habits from each other. Similarities between 'contact calls' were dependent on the length of time adult females spent grooming each other (and who their grooming partner was) rather than genetic relatedness. This means that while the general call repertoire of non-human primates is dependent on genetic factors, the fine structure within this is influenced by the company they kept. This behaviour also fits with the theory that human speech has evolved gradually from ancestral primate vocalisations and social patterns."

(AP) ? Mitt Romney is defending his years making millions in private business and says he'll handle attacks from Democrats who are trying to paint him as wealthy and out-of-touch.

In his first Sunday show interview in more than a year, Romney told Fox News Sunday that if he wins the nomination, he's prepared to handle characterizations by Democrats that he believes that "greed is good."

Romney says a photo shown of him and Bain Capital partners with dollar bills scattered everywhere was taken after they'd raised $37 million for the company's first venture capital fund. He says the fund was ultimately used to help build businesses and create jobs.

Romney says he's ready to handle attacks from Obama, saying "the president's going to go after me. I'll go after him."

NASA's RXTE detects 'heartbeat' of smallest black hole candidate

An international team of astronomers has identified a candidate for the smallest-known black hole using data from NASA's Rossi X-ray Timing Explorer (RXTE). The evidence comes from a specific type of X-ray pattern, nicknamed a "heartbeat" because of its resemblance to an electrocardiogram. The pattern until now has been recorded in only one other black hole system.

Named IGR J17091-3624 after the astronomical coordinates of its sky position, the binary system combines a normal star with a black hole that may weigh less than three times the sun's mass. That is near the theoretical mass boundary where black holes become possible.

Gas from the normal star streams toward the black hole and forms a disk around it. Friction within the disk heats the gas to millions of degrees, which is hot enough to emit X-rays. Cyclical variations in the intensity of the X-rays observed reflect processes taking place within the gas disk. Scientists think that the most rapid changes occur near the black hole's event horizon, the point beyond which nothing, not even light, can escape.

Astronomers first became aware of the binary system during an outburst in 2003. Archival data from various space missions show it becomes active every few years. Its most recent outburst started in February and is ongoing. The system is located in the direction of the constellation Scorpius, but its distance is not well established. It could be as close as 16,000 light-years or more than 65,000 light-years away.

The record-holder for wide-ranging X-ray variability is another black hole binary system named GRS 1915+105. This system is unique in displaying more than a dozen highly structured patterns, typically lasting between seconds and hours.

"We think that most of these patterns represent cycles of accumulation and ejection in an unstable disk, and we now see seven of them in IGR J17091," said Tomaso Belloni at Brera Observatory in Merate, Italy. "Identifying these signatures in a second black hole system is very exciting."

In GRS 1915, strong magnetic fields near the black hole's event horizon eject some of the gas into dual, oppositely directed jets that blast outward at about 98 percent the speed of light. The peak of its heartbeat emission corresponds to the emergence of the jet.

Changes in the X-ray spectrum observed by RXTE during each beat reveal that the innermost region of the disk emits enough radiation to push back the gas, creating a strong outward wind that stops the inward flow, briefly starving the black hole and shutting down the jet. This corresponds to the faintest emission. Eventually, the inner disk gets so bright and hot it essentially disintegrates and plunges toward the black hole, re-establishing the jet and beginning the cycle anew. This entire process happens in as little as 40 seconds.

While there is no direct evidence IGR J17091 possesses a particle jet, its heartbeat signature suggests that similar processes are at work. Researchers say that this system's heartbeat emission can be 20 times fainter than GRS 1915 and can cycle some eight times faster, in as little as five seconds.

Astronomers estimate that GRS 1915 is about 14 times the sun's mass, placing it among the most-massive-known black holes that have formed because of the collapse of a single star. The research team analyzed six months of RXTE observations to compare the two systems, concluding that IGR J17091 must possess a minuscule black hole.

"Just as the heart rate of a mouse is faster than an elephant's, the heartbeat signals from these black holes scale according to their masses," said Diego Altamirano, an astrophysicist at the University of Amsterdam in The Netherlands and lead author of a paper describing the findings in the Nov. 4 issue of The Astrophysical Journal Letters.

The researchers say this analysis is just the start of a larger program to compare both of these black holes in detail using data from RXTE, NASA's Swift satellite and the European XMM-Newton observatory.

"Until this study, GRS 1915 was essentially a one-off, and there's only so much we can understand from a single example," said Tod Strohmayer, the project scientist for RXTE at NASA's Goddard Space Flight Center in Greenbelt, Md. "Now, with a second system exhibiting similar types of variability, we really can begin to test how well we understand what happens at the brink of a black hole."

Launched in late 1995, RXTE is second only to Hubble as the longest serving of NASA's operating astrophysics missions. RXTE provides a unique observing window into the extreme environments of neutron stars and black holes.

Russia's Putin offers protesters small change (Reuters)

MOSCOW (Reuters) ? Vladimir Putin offered to ease slightly his tight political control of Russian politics in token concessions to protesters he suggested had been paid to turn out in the biggest demonstrations since he took power 12 years ago.

In a 4-1/2 hour call-in question-and-answer show that was broadcast live across Russia and intended to rebuild support as he prepares to reclaim the presidency, the long-serving prime minister sought to portray himself as a reasonable, even-handed national leader who can unite his people.

But many Russians on the social network Twitter suggested his efforts had failed, saying the 59-year-old former spy was out of touch three months before the presidential election he hopes to win.

Breaking his silence on rallies by tens of thousands of people on December 10 Putin mixed words of praise with suggestions that some of the demonstrators complaining of electoral fraud and demanding a new election were paid to show up.

"I saw on people on the TV screens ... mostly young people, active and with positions that they expressed clearly," Putin said. "This makes me happy, and if that is the result of the Putin regime, that's good -- there's nothing bad about it."

"They will at least make some money," he said, without saying who he thought might have been the paymaster. Putin has in the past, to the derision of opponents, suggested the United States had stirred protests and foreign states had funded them.

Putin, 59, said that at first he thought the white ribbons worn by the protesters as a sign of dissent were part of an anti-AIDS campaign, and he had mistaken them for condoms.

Dressed in a suit and tie at a large desk as he took questions by phone and from a studio audience, and sometimes via videolinks with cities across the vast country, he also looked less at ease than in previous years.

Putin, broaching the possibility of changes in a tightly controlled political system, suggested legislation might be altered to allow small opposition parties to be registered.

One of Putin's main acts after taking power in 1999 was to remove elected governors in Russia's regions and appoint his own representatives, restoring strong Kremlin control. This he said headed off a danger of the world's biggest country breaking up.

Putin hinted at reintroducing direct elections, but only after the president had approved candidates proposed by parties -- an idea scarcely likely to win support from critics.

"We can move in this direction," he said.

Putin gave no indication he would respond to the protesters' main demands such as sacking the central election commission chief and rerunning the election which returned Putin's United Russia party with a reduced majority.

He appears to be intent instead on riding out the protests and hoping they fade, although another day of protest is planned by the opposition on December 24.

"That's it. It's the end. Putin is completely out of touch. And this is becoming more obvious to everyone. You had to think hard to insult the people like this," wrote one person who identified himself as Oleg Kozyrev.

A 21-year-old trainee lawyer who gave his name only as Yevgeny said in the city of Yekaterinburg: "He did not even show any interest in what people were saying ... Aliens have nothing in common with earthlings."

PUTIN THOUGHT PROTESTERS HAD CONDOMS

Many of the people at rallies over alleged electoral fraud are young professionals in big cities who have answered online calls to protest and want the political system opened up to include a liberal opposition reflecting their views.

Some of their allegations were backed by international vote monitors who said the December 4 election was slanted to favor Putin's United Russia party, although it won only a slim majority in the lower house of parliament.

Many Russians saw an announcement by Putin and President Dmitry Medvedev on September 24 that they planned to swap jobs as a sign that everything had been cooked up between them with no respect for democracy. Putin confirmed on Thursday he wanted Medvedev to become premier after the March election.

Putin sought to appear democratic and unconcerned about the protests by saying they were "absolutely normal as long as everyone acts within the framework of the law."

"From my point of view, the result of the election undoubtedly reflects public opinion in the country," he said, making clear there would be no election rerun.

But at another point, he turned to the journalist hosting the call-in and said: "I've had enough of these questions about the elections."

IMAGE PROBLEMS

Russia-based economists said Putin was clearly having to work harder than in previous years to maintain his credibility and doubted he had won any new support in his performance.

"He's not winning any fresh votes. He didn't say anything to win the votes of the other crowd (of opponents) - he could have used this big event to push forward his rating," said Alexey Bachurin, of Renaissance Capital investment bank.

Putin has used the annual call-in he has held for the past decade to burnish his image as a strong leader with a detailed knowledge of the country and an interest in all its people. Thursday's show was the longest yet, beating out last year's by five minutes.

As usual there were many questions about social issues such as healthcare, pensions and housing, and Putin suggested he was the single leader capable of uniting and maintaining stability in the world's biggest energy producer.

As often in the past, he had strong words for the West, and particularly former Cold War enemy the United States.

"The United States does not need allies, it needs vassals," he said.

He defended his economic record, saying there had been some "remarkable and meaningful" achievements such as reducing poverty, despite the global economic crisis of 2008-09.

He hinted that former Finance Minister Alexei Kudrin, who is held in high regard by foreign investors and many young professionals, could return to government after falling out with the Kremlin in September.

"Such people were needed and will be needed in past and future governments," he said of Kudrin, who has spoken recently of forming a liberal party and suggested he might join protests.

Glee's Holiday Throwback: Let's Go Back to Christmas in the '60s! (omg!)

Oh, Marti Noxon, you had fun writing this one didn't you. The Buffy vet, who serves as a consulting producer on Glee this season, made her episodic writing debut with "Extraordinary Merry Christmas," a near-plotless throwback to The Judy Garland Show's boozy, high-as-a-kite holiday special (and old-timey variety specials in general). And why not? Last season, they turned Sue into the Grinch (literally) and gave Artie fake legs (literally). Why not deliver a holly-jolly Christmas by serving up some Yuletide chestnuts and the best of '60s TV (accents! corny jokes! canned laughter!)?

But in case you missed the story stuff, or forgot it, or blocked it, here's what you need to know: Mr. Schue picks Artie to direct a throwback Christmas special for Lima's cable-access station, which interferes with the glee club's promise to help Sue serve at a homeless shelter (this year, she's the anti-Grinch), but they show up anyway to sing the Band Aid classic "Do They Know It's Christmas?" Also, Sam and Rory bond over being alone for the holidays, and Rachel learns the true meaning of Christmas (and to love the pig that Finn bought her because it's the thought that counts).

The rest of the 30 or so minutes was filled by Artie's trippy vision, filmed in black and white, hosted by Kurt and Blaine (introduced as "my best friend and holiday roommate" in their "bachelor chalet") and starring all of New Directions minus Quinn and Sam. It was... oddly mesmerizing, hilarious and kinda weird, even for Glee. Look for the episode to divide Glee fans. There are those of us who don't mind a Rocky Horror hour, or hallucinating/huffing at the dentist... and there are the rest of you. Us? We liked the experimental special-within-the-special.

So given all that, we decided to rank the night's performances by how Christmas-y they made us feel, starting with the lump of coal.

8. "River" Nothing wrong with Joni Mitchell, and "River" doesn't make us depressed the way "Christmas Shoes" does. But if we're ranking songs in order of which gave us the warm fuzzies, this ain't it. Maybe if Rachel had been singing it for a particular reason instead of just auditioning it for Artie? Very un-Joni-like. ?

7. "Blue Christmas" Glee Project winner Damian McGinty is especially adept at handling slow oldies like this one, but can't they let Rory sing something fun? Cheerful? Up-tempo? Heck, just let him move around a bit instead of standing still in front of the choir room. (If you've been watching carefully like we have, you'll note he's a way worse dancer than Finn! Why aren't they exploiting it?) "That song was so depressing; I may actually be dead," Santana says, and the way Rory delivered it, we kind of have to agree.

6. "Extraordinary Merry Christmas" Pretty much every pop act in the last two decades has failed at crafting a new holiday classic (except for Mariah Carey, see below). Glee fares a little better with this original number, thanks to spirited performances by Rachel and Blaine, the bells in the background and the Santa shout-outs ? it's almost enough to cover up how very generic the song itself sounds.

5. "Let It Snow" Kurt and Blaine perform it within Artie's special, and producers thankfully didn't feel the need to modernize the track. A little less production goes a long way when it comes to a good yuletide number. Plus: The pair bust out some pretty smooth dances moves straight out of an Andy Williams' variety hour.

4. "Do They Know It's Christmas?" Mixed with images of New Directions giving wrapped gifts to homeless children, the final song of the episode is certainly feel-good and familiar enough, it's just not our favorite Christmas song, leaning more toward "Christmas Shoes" in sentiment. Still, it would have been a nice ending to the episode.

3. "Santa Claus Is Coming to Town" Yes. Put a tambourine in Finn's hand more often! He and Puck manage to take the schmaltz down just a notch (even while dressed as Luke Skywalker and Han Solo) and infuse Artie's throwback with some much-needed rock. Thanks to Puck's dorky, toothy grin and Finn's high energy, this much-covered rendition still packs a cheesy and powerful Christmas punch. (And producers, if you need any more proof Cory Monteith needs to cover Bruce Springsteen, look no further.)

2. "Christmas Wrapping" The Waitresses' 1981 song about a woman too busy for Christmas may be a little too new wave-y (and obscure) for some Glee watchers (even though the Spice Girls did cover it), but hello? The Cheerios decked out in Santa outfits? Twirling ribbons? Brittany bouncing around front and center? Christmas wish fulfilled.

1. "All I Want for Christmas Is You" Is there any better way to start out a Christmas episode than with Mercedes tackling this Mariah Carey piece of pop perfection? No. Sure, it had no point in the episode, but (clearly) we like watching these kids romp around to holiday music. And since we even fondly remember the Olivia Olson version from Love Actually, of course we love this one. If it doesn't get you on your feet, try checking for a pulse.
