Rajat Gupta Could Go to Prison for 10 Years for Insider Trading

On Wednesday Rajat Gupta will appear in Manhattan federal court to be sentenced for passing secrets he learned, while serving on the board of directors of Goldman Sachs, to Raj Rajaratnam, the former chief of hedge fund giant Galleon Group. Rajaratnam himself was convicted in May 2011 of being the center of the biggest insider trading ring in decades. He?s serving 11 years for his crimes, one of the longest sentences ever for insider trading.

Like Rajaratnam, Gupta, the former head of McKinsey & Company, deserves punishment. He was convicted of a type of securities fraud, and fraud is a form of theft. He wrongly used his position of power and influence for personal advancement, corroding Main Street?s trust and confidence in Wall Street.?

Still, Gupta is no Rajaratnam. Gupta tipped inside information about one company to Rajaratnam, while Rajaratnam traded on confidential information collected from many sources. So you?d expect that Gupta would be treated differently when he appears for sentencing. Federal sentencing guidelines, however, suggest a prison term for him that?s similar in length to the 11 years Rajaratnam is serving. And prosecutors want a sentence within those guidelines, just as they want for the hundreds of defendants sentenced in federal courts nationwide every day. Because what Gupta and Rajaratnam did is so different, though, sentencing Gupta to anything like the time Rajaratnam is serving undermines the whole purpose of the sentencing scheme that prosecutors say they want to uphold.

Lawmakers enacted the federal guidelines in 1987 to try to ensure that defendants who?d committed like crimes received like sentences. They replaced the discretion that judges traditionally enjoyed with a rigid system of mathematical calculations for determining prison term length. Those guidelines were the law of the land until the Supreme Court?s 2005 decision in United States v. Booker, which untethered judges from strict application of the guidelines and returned to them many of the powers that had been wiped away 18 years earlier. Today, the guidelines are advisory, not mandatory.

Nevertheless, the Department of Justice still believes that the guidelines should be faithfully followed and that judges are wrong to deviate from them. In a 2010 speech to the American Bar Association, Lanny Breuer, assistant attorney general for the DoJ?s Criminal Division, cautioned that the department is ?especially concerned about increased disparity in white-collar sentencing.??In November 2011 Breuer reiterated to another audience that among the ?serious challenges? facing federal sentencing and corrections policy is increased ?disparities in federal sentencing? in recent years. In 2012, the DoJ?s annual report to the United States Sentencing Commission, the independent agency that develops and implements the guidelines, expressed concern about ?continuing erosion of the guidelines,? and said that ?serious reform? of federal sentencing law and policy ?is necessary.?

Strict application of the guidelines, though, precludes consideration of a whole host of factors relevant to fixing just and appropriate prison terms, like offenders? differing personal histories and their distinctive characteristics. That?s especially unfortunate when it means that the person at the top of a scheme and someone at the bottom end up being sentenced in the same way. Rajaratnam and Gupta provide a perfect example. They both were convicted of insider trading. But while Rajaratnam?s business was trading on inside information, Gupta didn?t buy or sell a single share of stock. Likewise, Rajaratnam made millions, while Gupta didn?t make any money. And Rajaratnam was caught on tape scheming with his co-conspirators. No such recordings of Gupta exist. Still, the former McKinsey chief faces up to 10 years in prison, almost as much time as the former Galleon head is serving.

Gupta and Rajaratnam are like the kingpin and corner street dealer who do roughly the same amount of time for drug dealing, as happens to a disturbing degree in narcotics cases (which accounted for almost 30 percent ?of the 80,000-plus cases resolved in federal court in 2011). Because drug sentences are fixed by drug type and quantity, not role, defendants in distribution rings face the same potential penalty, whatever their actual position and conduct.? (a laboratory services company) and artificially inflate its stock price. The guidelines recommended life imprisonment for him, even though other people had concocted and operated the scheme for years before Adelson joined it. Judge Rakoff gave him 42 months, describing the life sentence recommended by the guidelines as ?patently unreasonable.?

It?s because of Judge Rakoff that Gupta is widely expected to receive a sentence considerably less than what federal guidelines recommend, no matter what the government?s lawyers say. CONFERENCE OVERVIEW

CISSE 2012 provides a virtual forum for presentation and discussion of the state-of the-art research on computers, information and systems sciences and engineering. CISSE 2012 is the eighth conference of the CISSE series of e-conferences. CISSE is the World's first Engineering/Computing and Systems Research E-Conference. CISSE 2005 was the first high-caliber Research Conference in the world to be completely conducted online in real-time via the internet. In 2005, CISSE received 255 research paper submissions and the final program included 140 accepted papers, from more than 45 countries. Last year, CISSE 2011 received more than 300 submissions and the final program included 105 accepted papers, from more than 80 countries.

The virtual conference will be conducted through the Internet using web-conferencing tools, made available by the conference. Authors will be presenting their PowerPoint, audio or video presentations using web-conferencing tools without the need for travel. Conference sessions will be broadcast to all the conference participants, where session participants can interact with the presenter during the presentation and/or during the Q&A slot that follows the presentation. This international conference will be held entirely on-line. The accepted and presented papers will be made available and sent to the authors after the conference both on a DVD (including all papers, PowerPoint presentations and audio presentations) and as a book publication. Springer, the official publisher for CISSE, published the previous seven CISSE book proceedings.

Conference participants - authors, presenters and attendees - only need an internet connection and sound available on their computers in order to be able to contribute and participate in this international ground-breaking conference. The on-line structure of this high-quality event will allow academic professionals and industry participants to contribute their work and attend world-class technical presentations based on rigorously refereed submissions, live, without the need for investing significant travel funds or time out of the office.

The concept and format of CISSE is ground-breaking. The PowerPoint presentations, final paper manuscripts and time schedule for live presentations over the web had been available for weeks prior to the start of the conference for all registrants, so that the participants can choose the presentations they want to attend and think about questions that they might want to ask. The live audio presentations were also recorded and are part of the permanent CISSE on-line archive - accessible to all registrants- which also includes all the papers, PowerPoint and audio presentations.

Potential non-author conference attendees who cannot make the on-line conference dates are encouraged to register, as the entire joint conferences will be archived for future viewing.

The CISSE conference audio room provides superb audio even over low speed internet connections, the ability to display PowerPoint presentations, and cross-platform compatibility (the conferencing software runs on Windows, Mac, and any other operating system that supports Java). In addition, the conferencing system allowed for an unlimited number of participants, which in turn granted us the opportunity to allow all CISSE participants to attend all presentations, as opposed to limiting the number of available seats for each session.

Imagine millions of people taking a photo all around the world at exactly the same second. That's what'll happen if enough people download a new free app?? and then remember to use it when the moment arrives.

The app, which will be available for both iPhone and Android,?is called Worldsecond. It's funded by Montblanc, makers of fine watches and pens.?The system is pretty straightforward: You download the app and you wait for the countdown. When it reaches zero, the virtual?shutter clicks and?your image is uploaded to the Worldsecond site, where you'll be able to browse through other pictures taken at that exact moment.

The?idea isn't entirely new; there have been apps and services that let you trade photos with people snapping one at the same time but elsewhere. But carrying it out on this scale certainly hasn't been done before.

Though everyone who gets the app?will no doubt gather, like a virtual Hands Across America, for that first Kodak?moment, there will in fact be others. The Worldsecond?website says that a total of 60 photo opps?will happen before the end of the year, and there are even prizes: one for the best single image, and one for the most creative gallery of images.

Man Pleads Guilty in New York to Conspiring with Iranian Military Officials to Assassinate Saudi Arabian Ambassador to the United States

Manssor Arbabsiar, aka Mansour Arbabsiar, pleaded guilty today in federal court in the Southern District of New York to participating in a plot to murder the Saudi Arabian Ambassador to the United States while the Ambassador was in the United States. Arbabsiar, a 58-year-old naturalized U.S. citizen holding both Iranian and U.S. passports, was arrested on Sept. 29, 2011, at New York?s John F. Kennedy International Airport. He pleaded guilty today before U.S. District Judge John F. Keenan.

The guilty plea was announced by Attorney General Eric Holder; Michele M. Leonhart, Administrator of the Drug Enforcement Administration ( DEA); Lisa Monaco, Assistant Attorney General for National Security; Preet Bharara, U.S. Attorney for the Southern District of New York; and Stephen L. Morris, FBI Houston Special Agent in Charge.

Arbabsiar pleaded guilty to a superseding information that charges him with three counts. Count one charges Arbabsiar with traveling in foreign commerce and using interstate and foreign commerce facilities in the commission of murder-for-hire. Count two charges him with conspiring to do so. Count three charges Arbabsiar with conspiring to commit an offense against the United States, namely, an act of terrorism transcending national boundaries. He faces a maximum potential sentence of 25 years in prison (10 years on counts one and two, and five years on count three). Arbabsiar is scheduled to be sentenced by Judge Keenan on Jan. 23, 2013, at 11:30 a.m.

In connection with his guilty plea, Arbabsiar admitted that, from the spring of 2011 to the fall of 2011, he conspired with officials in the Iranian military who were based in Iran, to cause the assassination of the Saudi Arabian Ambassador while the Ambassador was in the United States. Arbabsiar acknowledged that at the direction of these co-conspirators, he traveled to Mexico on several occasions during 2011 in order to arrange the assassination of the Ambassador. Arbabsiar admitted that, with his co-conspirators? approval, he had arranged to hire a DEA confidential source (CS-1), who claimed to be a representative of a drug cartel, and CS-1?s criminal associates, to murder the Ambassador. Arbabsiar further admitted that he agreed to pay $1.5 million to CS-1 and had discussed with CS-1 a plan to murder the Ambassador at a restaurant in Washington, D.C. ? a plan that was approved by Arbabsiar?s co-conspirators. Arbabsiar then arranged for a $100,000 down payment, in two installments, to be wired to CS-1.

As noted in the complaint and indictment previously filed in Manhattan federal court, t he Qods Force is a branch of the Iranian Islamic Revolutionary Guard Corps (IRGC). The Qods Force conducts sensitive covert operations abroad, including terrorist attacks, assassinations and kidnappings, and is believed to have sponsored attacks against Coalition Forces in Iraq. In October 2007, the U.S. Treasury Department designated the Qods Force under Executive Order 13224 for providing material support to the Taliban and other terrorist organizations.

?A little more than a year after his arrest, Manssor Arbabsiar has admitted to his role in a deadly plot approved by members of the Iranian military to assassinate a sitting foreign Ambassador on U.S. soil,? said Attorney General Holder. ?Today?s plea and the disruption of this plot should serve as a reminder of the exceptional efforts of our law enforcement and intelligence agencies in protecting America against terrorist attacks and in holding accountable those who plan such actions.?

?The dangerous connection between drug trafficking and terrorism cannot be overstated, and this case is yet another example of DEA?s unique role in identifying potentially deadly networks that wish to harm innocent Americans and our allies worldwide,? said DEA Administrator Leonhart. ?Using DEA?s elaborate and sophisticated investigative expertise to infiltrate violent drug and terror organizations globally, we successfully identified this threat and worked closely with the FBI to prevent a potentially deadly outcome.?

?Thanks to the collaborative efforts of many U.S. law enforcement and intelligence professionals, this international assassination plot hatched in Iran was thwarted before anyone was harmed and a key conspirator has pleaded guilty. This case underscores the evolving threat environment we face and the need for continued vigilance at home and abroad,? said Assistant Attorney General Monaco.

U.S. Attorney Bharara stated: ?As was originally charged, and as Arbabsiar has now admitted, he was the extended murderous hand of his co-conspirators, officials of the Iranian military based in Iran, who plotted to kill the Saudi Ambassador in the United States and were willing to kill as many bystanders as necessary to do so. Arbabsiar traveled to and from the United States, Mexico and Iran and was in telephone contact with his Iranian confederates while he brokered an audacious plot. The audacity of the plot should not cause doubt, but rather vigilance regarding others like Arbabsiar, who are enlisted as the violent emissaries of plotting foreign officials. This office will continue to pursue the co-conspirators in this plot and others in Iran or elsewhere who try to export murder. Thanks to the great work of the FBI, DEA and the prosecutors in this office, Mr. Arbabsiar must now answer for his conduct.?

?Today?s guilty plea entered by Mr. Arababsiar is the culmination of exceptional intelligence and law enforcement efforts,? said FBI Special Agent in Charge Morris. ?I would like to thank the investigators, analysts and task force officers at the FBI and DEA in Houston, our Legal Attach? Office in Mexico City, and all partners in the Intelligence Community who worked tirelessly on this case. Of special note I?d like to recognize the exemplary leadership from Department of Justice?s National Security Division and the U.S. Attorney?s Office in the Southern District of New York.?

According to the complaint and indictment filed in Manhattan federal court, as well as the information to which Arbabsiar pleaded:

Arbabsiar met with CS-1 in Mexico on multiple occasions between May 2011 and July 2011. During the course of these meetings, Arbabsiar inquired as to CS-1?s knowledge with respect to explosives and explained that he was interested in, among other things, attacking an embassy of Saudi Arabia and the murder of the Saudi Ambassador to the United States. In a July 14, 2011, meeting in Mexico, CS-1 told Arbabsiar that he would need to use at least four men to carry out the Ambassador?s murder and that his price for carrying out the murder was $1.5 million. Arbabsiar agreed and stated that the murder of the Ambassador should be handled first, before the execution of other attacks that Arbabsiar had discussed with CS-1. Arbabsiar also indicated that he and his associates had $100,000 in Iran to pay CS-1 as a first payment toward the assassination.

During the same meeting, Arbabsiar also described to CS-1 his cousin in Iran, who he said had requested that Arbabsiar find someone to carry out the Ambassador?s assassination. Arbabsiar indicated that his cousin was a ?big general? in the Iranian military; that he focuses on matters outside of Iran and that he had taken certain unspecified actions related to a bombing in Iraq.

In a July 17, 2011, meeting in Mexico, CS-1 noted to Arbabsiar that one of his workers had already traveled to Washington, D.C., to surveil the Ambassador. CS-1 also raised the possibility of innocent bystander casualties. Arbabsiar made it clear that the assassination needed to go forward, despite mass casualties, telling CS-1, ?They want that guy [the Ambassador] done [killed], if the hundred go with him f**k ?em.? CS-1 and Arbabsiar discussed bombing a restaurant in the United States that the Ambassador frequented. When CS-1 noted that others could be killed in the attack, including U.S. senators who dine at the restaurant, Arbabsiar dismissed these concerns as ?no big deal.?

On Aug. 1 and Aug. 9, 2011, Arbabsiar caused two overseas wire transfers totaling approximately $100,000 to be sent to an FBI undercover account as a down payment for CS-1 to carry out the assassination. Later, Arbabsiar explained to CS-1 that he would provide the remainder of the $1.5 million after the assassination. On Sept. 20, 2011, CS-1 told Arbabsiar that the operation was ready and requested that Arbabsiar either pay one half the agreed upon price ($1.5 million) for the murder or that Arbabsiar personally travel to Mexico as collateral for the final payment of the fee. Arbabsiar agreed to travel to Mexico to guarantee final payment for the murder.

On Sept. 28, 2011, Arbabsiar flew to Mexico. Arbabsiar was refused entry into Mexico and was placed on a return flight destined for his last point of departure. On Sept. 29, 2011, Arbabsiar was arrested by federal agents during a flight layover at JFK International Airport in New York. Several hours after his arrest, Arbabsiar was advised of his Miranda rights and he agreed to waive those rights and speak with law enforcement agents. During a series of Mirandized interviews, Arbabsiar confessed to his participation in the murder plot.

Arbabsiar also admitted to agents that, in connection with this plot, he was recruited, funded, and directed by men he understood to be senior officials in Iran?s Qods Force. He said these Iranian officials were aware of and approved of the use of CS-1 in connection with the plot; as well as payments to CS-1; the means by which the Ambassador would be killed in the United States and the casualties that would likely result.

Arbabsiar also told agents that his cousin, who he had long understood to be a senior member of the Qods Force, had approached him in the early spring of 2011 about recruiting narco-traffickers to kidnap the Ambassador. Arbabsiar told agents that he then met with CS-1 in Mexico and discussed assassinating the Ambassador. Arbabsiar said that, afterwards, he met several times in Iran with Gholam Shakuri, aka ?Ali Gholam Shakuri,? a co-conspirator and Iran-based member of the Qods Force, and another senior Qods Force official, where Arbabsiar explained that the plan was to blow up a restaurant in the United States frequented by the Ambassador and that numerous bystanders would be killed. The plan was approved by these officials.

In October 2011, after his arrest, Arbabsiar made phone calls at the direction of law enforcement to Shakuri in Iran that were monitored. During these phone calls, Shakuri confirmed that Arbabsiar should move forward with the plot to murder the Ambassador and that he should accomplish the task as quickly as possible, stating on Oct. 5, 2011, ?[j]ust do it quickly, it?s late?? Shakuri also told Arbabsiar that he would consult with his superiors about whether they would be willing to pay CS-1 additional money. Shakuri, who was also charged in the plot, remains at large. The charges against Shakuri are merely accusations, and he is presumed innocent unless and until proven guilty.

This investigation is being conducted by the FBI Houston Division, the DEA Houston Division and the FBI New York Joint Terrorism Task Force. The prosecution is being handled by the Terrorism and International Narcotics Unit of the U.S. Attorney?s Office for the Southern District of New York, specifically Assistant U.S. Attorneys Glen Kopp, Edward Kim and Stephen Ritchin. The Counterterrorism Section of the Justice Department?s National Security Division and the Office of International Affairs of the Justice Department?s Criminal Division provided substantial assistance. The government of Mexico is also recognized for its cooperation in this matter.

New JCT Study Shows Futility of Base-Broadening to Pay for ...

As long as the only thing we?re going to talk about for the next few weeks in the election is taxes, I might as well provide the update. The Joint Committee on Taxation, the ?CBO for taxes? as it were, the nonpartisan scorekeeper on tax policy, just released a report that should end all discussion about the Romney campaign?s plans for a deficit-neutral 20% across-the-board rate cut.

Repealing all itemized deductions in the U.S. tax code would pay for only a 4 percent cut in income tax rates, according to an estimate from the nonpartisan scorekeeper for Congress that casts doubt on Republicans? ability to finance lower income-tax rates with base broadening.

The analysis by the Joint Committee on Taxation shows the arithmetical difficulty of an approach that assumes long-favored tax breaks such as deductions for mortgage interest and charitable contributions could be repealed instantly and completely. Republican presidential nominee Mitt Romney proposes a 20 percent income-tax cut and says he would pay for it by limiting tax deductions, credits and exemptions.

There are some important differences between Romney?s approach and the JCT analysis that make it difficult to compare the 4 percent finding in the study with Romney?s promise of a 20 percent tax cut. Much of the base broadening in the analysis pays for some changes that Romney assumes in his starting point and for policies from the 2009 stimulus law that he may not want to extend. That means he would able to use the changes to deductions to cut rates by more than 4 percent.

The estimate assumes the expiration of the Bush-era tax cuts completely, and the base-broadening pays for the perennial patch to the alternative minimum tax (in fact, it pays for a repeal of it, as well as extensions of the increased child tax credit and Earned Income Tax Credit). That changes what the rate cut would actually look like, and so this is not a perfect indicator of the Romney plan. But the basic principle applies, and it?s so far from the reality of what Romney wants to achieve ? a 20% rate cut without adding to the deficit, and without an increase on the middle class ? that I think it serves as more evidence of the futility of the exercise. Indeed, many of the other tax expenditures that JCT doesn?t use here are ones that Romney has already taken off the table.

Mark Zandi, the Moody?s.com economist always trotted out to bless this or that plan, admitted today that the Romney plan is mathematically impossible.

For those that care about the deficit, it?s worth noting that the last major cut to taxes, the Bush-era tax cuts, accounts for the majority of the deficit problem currently, particularly in the out years. The tax cuts and the two wars will account for $9 trillion in deficits between their inauguration and 2019, under current policy. So throwing another $5 trillion tax cut that cannot be plausibly offset on the pile makes even less sense, especially in the constrained, non-MMT environment of Washington.

You can end the rise in the debt-to-GDP ratio ENTIRELY, in fact, by simply letting the Bush-era tax cuts expire. And I would do it, triggered by a return to normal employment and phased in gradually on the lower end of the scale. What I would not do is an ill-advised 20% tax cut that cannot be plausibly offset, and which would leak out at much greater rates to the rich, at the expense of the poor.

Iraq al Qaeda says it masterminded jailbreak

BAGHDAD (Reuters) - Al Qaeda's Iraqi wing said it masterminded a jailbreak in the northern city of Tikrit last month and smuggled weapons to inmates, according to a statement posted on militant websites on Friday.

Dozens of prisoners, many of them convicted members of al Qaeda on death row, fought their way out of the jail, killing 16 members of the security forces in ensuing clashes.

In its statement, the Islamic State of Iraq said it had planned the mass escape, sent the prisoners arms and detonated a car bomb outside the prison gate to allow them to flee.

"The unique operation began by infiltrating the security system of the jail... and entering silenced weapons, grenades and explosive belts for the jailed brothers inside the prison, and coordinating with them to take control from inside," the statement read.

Iraq's Interior Ministry has accused prison officials of complicity in the jailbreak, during which the fleeing inmates destroyed prison records.

Eighty members of the security forces were either killed or wounded in the attack, said the group. It also claimed responsibility for 62 other attacks in Iraq over the past three months, most of them targeting security forces and Sunni government-backed militias.

Iraq is home to a number of Sunni Islamist insurgent groups which continue to launch attacks designed to undermine the Shi'ite-led government.

Security at prisons was beefed up following the jail break and some inmates were transferred to fortified jails.

Last September, 35 prisoners facing terrorism charges escaped via a sewage pipe from a temporary jail in the northern city of Mosul, an al Qaeda stronghold.

Kaila Colbin has an interesting piece today on what the Internet has meant, and may mean, for the future of journalism. She starts with the argument that
The need for speed is not only killing your company, it is destroying any standards of accuracy and integrity that remain, resulting in, for example, media outlets publishing reports on Supreme Court decisions before said Court has even finished reading said decision.
That's hardly news, though, or solely the fault of the Internet.? From journalism's earliest days, being first with the news has been an important focus. As newer media forms develop, particularly those that can package and disseminate their news products more quickly, the tempo of journalism speeds up.? Before the Internet was widely diffused, cable news networks 24/7 news cycle and potential for real-time coverage of events, critics say, transformed the focus on speed to a critical need for immediacy.? Another outside influence is money - specifically the commercial nature of most news outlets, and the need to generate sufficient customers to subsidize news (directly through subscription or indirectly through advertising or other subsidies).? When money was flush in news, it had little impact on journalism; but digital technology and the Internet expanded competition and shifted revenue streams to the point where most news organizations have shifted from serving audiences to battling for audiences.? And getting and keeping your audience becomes a primary focus.
?? The problem for journalism, though, is not the simple facts of a faster news cycle or commercialism - it's the concern that the push to be first and to attract audiences is trumping core journalistic principles of verification and accuracy. Colbin illustrates the concern with a quote from Jeremiah Owyang, an analyst for research firm Forrester.
??the way today?s world is set up is that 1) whoever publishes first (whether it's accurate or not) 2) whoever is the most interesting (and thereby gets the most social shares and rewarded by Google) wins? the only way for journalism to focus on fact checking and accuracy is to change the business model, and if the two requirements listed above (fast and interesting) get page views (and thereby ad dollars)? this will only persist.?
To be fair, I'd argue that the Internet isn't directly responsible for any decline in journalism, at least not in that way.? In terms of speed and money, the rise of the Internet has provided a platform for greatly expanding the level of competition traditional news outlets face - and pushed a need for them to try to make their news products more competitive, and more valuable to potential news consumers.? But shifting focus to speed and entertainment over traditional news values isn't the only option news organizations have to try to be more competitive or valuable to the market.? In fact, I'd argue that doing so lessens the core news value of their product and makes them less competitive.? For journalism and those organizations that are first and foremost "news outlets," those are bad business practices and business models.? For "gossip" or entertainment outlets, not so bad.
? I would add that I think that the Internet's most significant negative impact on news and journalism - or at least people's perception of news - comes from a different pair of structural features: interactivity and disintermediation.? By opening up the range of news and information sources, the Internet allows news consumers to bypass the traditional gatekeepers of news.? They no longer have to rely on journalists' judgements on what's newsworthy, or more critically, their accuracy.? Internet news consumers can independently authenticate or verify news and information, or its falsehood.? And the more the Internet news consumer finds discrepancies in news judgements and reporting, the less faith and trust they place in journalism and the less value they place in those news products.
? Interactivity contributes to that spiral in a couple of ways.? First, news consumers can themselves become news producers - adding their perceptions of events they witness, or contributing specialized expertise in topics addressed in news reports. Second, when people do so in good faith, the response of the "real journalists" is often dismissively arrogant, and sometimes openly hostile.? That's not going to help build faith and trust.

? But the impact of the Internet on news and journalism does not need to be significantly and relentlessly negative.? For instance, journalists and editors could, in most cases, employ the Internet and digital telecommunication to quickly and easily authenticate and verify information - meaning that those traditional journalistic principles do not necessarily need to be sacrificed at the altar of speed and immediacy. In addition, providing access to background information, original source materials, and other supporting information can add value to the basic news story.
? Journalists could also take advantage of the Net's interactivity to seek out, identify, and work with relevant experts when covering stories outside their own level of expertise. Colbin notes one such effort - The Conversation - that pairs journalists with academic experts to the benefit of both.? Academics get more, and more accurate, reporting on research results, and journalists get access to the expertise to allow them to better evaluate the information they get from outside sources and to provide a fuller understanding of the background and context of breaking news.
? In addition, the Internet offers the potential to explore new business models and funding sources.? The news industry collectively bemoans the fact that online advertising revenues have not yet been sufficient to replace declines in traditional advertising revenues, and are unsure about the potential for subscription or direct purchase revenue potential.? True, but beside the point - online news outlets have a cost advantage in that their distribution costs are minimal.? Besides, online advertising revenues are the fastest growing sector in advertising/marketing spending, and online news outlets are increasingly considering and testing pay/subscription models.? Currently, there are enough successful online pay/subscription models out there to suggest that they could be reliable revenue streams, if the outlets can develop a mix of content, a market segment that recognizes that value, and a pricing scheme that works for that mix.? But the real opportunity of the Internet is that it enables so many other revenues sources and streams, including donations/subsidies, pre-pay models, crowdsourcing, etc.? Earlier this year, the Pew Project for Excellence in Journalism looked at a range of alternative online funding sources.? Colbin discusses the background for Avaaz Daily Briefing, funded through donations from more that 20,000 people.

? Certainly, the Internet, along with the explosion of digital technology and telecommunications, has, and continues to, radically reform media and news markets, principally by radically increasing the options for news consumers and increasing competition for traditional news outlets that, for the most part, hadn't faced intense competition in decades.? But the same forces increasing competition are creating new opportunities for creating and disseminating news and information, for traditional news outlets as well as other individuals and organizations.? Admittedly, not all of these new and alternative outlets will be financially successful, or will produce accurate and trustworthy information.? But there's nothing that would inherently prevent the production and distribution of journalism in its highest and proudest traditions.? In fact, the Internet makes doing that much more possible - it will be up to news organizations to take advantage and compete successfully in the news/journalism market.

Rohit Sharma hoping to take T20 form into ODIs ? Cricket News Update

India?s middle-order batsman Rohit Sharma, who has had a struggling time in the ODIs this year, is hoping to take his impressive T20 form into the 50-overs format.

The 25-year-old Maharashtra batsman, who is regarded as a highly talented youngster with amazing wrists and sublime timing, has been going through a lean patch for some time now. In 13 One day Internationals played in 2012, the right-hander could manage only 164 runs, with only one half century, a 68-run knock against Pakistan, in Asia Cup, in March.

The Maharashtra batsman had a nightmarish tour of Sri Lanka in July, where he scored just 13 runs in five innings in the five-match ODI series against the hosts. However, he impressed his fans and silenced his critics with his heroics in the recently concluded ICC World T20 Championship, on the same Sri Lankan pitches where he had struggled a month ago. He scored two half centuries during the marquee tournament, 56 against Pakistan in a warm-up game and a 55 not out against England in a Group A fixture.

"I enjoy my stints in Twenty20. I sincerely hope I can adapt this to one-day cricket too, and do what I manage to do in T20," Rohit said in an exclusive interview with the?Times of India. "I have succeeded in this format regardless of conditions, batting order and any other factors. I hope it rubs off on other formats too," he added further.

Since making his international debut back in 2007, Sharma has to date played 85 ODIs and 32 T20 Internationals but he is yet to confirm a spot in the national set-up. The under-fire batsman also blamed his continuously changing batting position for his poor form.

"I've opened the batting, batted at numbers 3, 4, 7... I have batted wherever I have been asked to," said the Indian batsman, who is yet to debut in the Test format. "If I was an opener, it would've given me time to go out there and figure things out," he added further.

Rohit?s lack of form earned him criticism from all directions, with his critics questioning his temperament and casual approach to the game. The Maharashtra batsman said that the criticism does hurt, but he tries to stay away from it and focus on his game.

Buy the Vacant Foreclosure Next Door? Even With the Money, It's ...

What would you do if the vacant foreclosure next door was falling into disrepair and threatening your own home's value? If you're like Homosassa, Fla., resident Lisa Cocuzza, you'd try to buy it and fix it up.

That was Cocuzza's plan five years ago when a for-sale sign went up at a vacant foreclosure across the street. Worried that the property would continue to deteriorate and soon blight her neighborhood, she offered to pay its full asking price of $69,000. But three days before the deal was to close, she said, it fell through because of problem involving the lenders who owned the home.

This seems to be a typical story line for homeowners across the country -- many of whom are growing so desperate to preserve their neighborhoods that they're willing to buy the foreclosure next door -- only to fail. The foreclosures then tend to continue to sit empty and chip away at the surrounding homes' values.

An estimated 1.5 million homes in the U.S. are bank-owned or in some stage of foreclosure, according to online foreclosure marketplace RealtyTrac. But the complications of buying one can make them difficult, even impossible, for an average homebuyer to purchase.

In Cocuzza's case, there was more than one mortgage on the foreclosed home that she was trying to buy. A second financial institution had a $14,000 lien, or claim, on the home, which meant that this unpaid debt would have to be tacked onto the $69,000 asking price. This didn't come to light until Cocuzza was about to close on her purchase. That's when she found out she'd have to pay $83,000 for the home -- an amount she couldn't afford, she said.

Ever since that deal fell through five years ago, Cocuzza said, the home has remained vacant and hasn't been re-listed for sale. She's continued to do what she can to keep the property from total disarray, she said. She clips bushes, pulls weeds and has hung a bird feeder and wind chimes.

"I kind of go over there if I see any trash that might have blown into the yard," said Cocuzza. "I put out little decorations and keep it up as best I can."


Other homeowners who have tried to buy foreclosures in their neighborhoods have faced other costly surprises.

A homebuyer in Taylorsville, Utah, lost the chance to buy a dilapidated foreclosure in his neighborhood because the bank wouldn't negotiate on needed repairs, said Darnell DeBrule, an employee at Deseret First Credit Union of Salt Lake City. The buyer was DeBrule's client.

DeBrule said the buyer "feared an investor would purchase the property as-is and have little-to-no concern regarding its effect on the neighborhood as a whole," so the buyer offered to pay the full asking price for the foreclosure, as well as an inspection. That's when things went south.

The inspection found the home to be badly contaminated with hazardous chemicals used to make the street drug, methamphetamine. When the buyer suggested splitting the cost of rehabilitating the home, the bank shut down the deal, DeBrule said.

The bank said it was "not putting in a dime" and now would only accept a cash offer, DeBrule recalled. That meant the buyer, who was planning on taking out a mortgage to buy the home, could no longer afford it. And it left the door open for a cash-rich investor to swoop in and snap it up.

Banks mostly prefer offers from investors anyway, said Marty Boardman, chief financial officer of Rising Sun Capital Group, a home investor based in Nevada. That's because they have deeper pockets and are more capable of paying in cash -- and cash deals, which carry fewer contingencies, are more likely to close, he said.

"Their competitive advantage can be frustrating to homeowners like DeBrule's client, since "investors don't necessarily care about neighborhood vitality," said Douglas Robinson, a spokesman for NeighborWorks America, which rehabs foreclosures and sells or rents them to low-income Americans.

Along with stiff competition from investors, those who want to buy foreclosures in their neighborhoods sometimes encounter another -- surprising -- hurdle: just finding a home's true owner.

Mark Hankins, of Land O' Lakes, Fla., wanted to create a neighborhood trust to buy a nearby home that's languished in foreclosure purgatory for two years, but public records on it proved a dead end, he said. Six financial institutions have been involved in foreclosure proceedings on the property since JPMorgan Chase initiated foreclosure on it in 2009, the records show, and the law firm that manages the trust in possession of the home no longer exists.

"If somebody diligent wanted to make an offer to the current beneficial owner," Hankins said, "nobody has any idea how to contact them to make the offer."

And you'd think that if anybody could find the owner, Hankins could. He's a foreclosure attorney who wrote a book about how to cope with debt.

In the success story of Lori Hiscock, though, it's easy to see why some homeowners like Hankins would like to take foreclosures under their wings. Hiscock bought a foreclosure around the corner from her home in Granger, Ind.

The home had begun to show signs of decay more than a year ago, and someone had "put a black Christmas tree on the front porch and wrote 'bah humbug,' " Hiscock said.

Though Hiscock doesn't consider herself an investor, she bought the home in cash in June and spent $15,000 to rehab it. Neighbors were worried about the home being rented out after it sold, Hiscock said. But they warmed to the idea once they realized the owner lived nearby.

"We love the neighborhood, and we love the home, and we got to pick our new neighbors," Hiscock said.

The entire neighborhood may benefit from Hiscock's move. In one broad stroke, she removed an eyesore, fought off blight that threatened the home and propped up home values.

It also didn't hurt that Hiscock was a savvy and desirable buyer: She works as a loan officer, and she had the money to buy the home without a mortgage.

"I wouldn't have realized that making a cash offer, using a Realtor experienced in foreclosure sales, and making the offer without it being subject to any inspections would have made a difference," she said, "if I didn't know this process so well."
